USCIS Clarifies That No Changes to H1-B Visa Rules Will Be Made

Last week, technology firms and Indian H1-B workers were alarmed when news reports were posted indicating that the USCIS was planning to make changes to the H1-B visa rule of filing extensions beyond the 6-year period that would have forced H1-B visa holders to leave the U.S. while waiting for their green card applications to be processed. Today, USCIS Chief of Media Relations Jonathan Withington issued a statement saying that, “What we can say, however, is that USCIS is not considering a regulatory change that would force H1-B visa holders to leave the United States by changing our interpretation of section 104(c) of AC-21, which provides for H1-B extensions beyond the 6-year limit.”
