Immigrant Children Not Entitled to Right to Government-paid Free Lawyer, Says Federal Court

The Ninth U.S. Circuit Court of Appeals based in San Francisco, California on Monday ruled in the case of C.J.L.G. v. Jefferson B. Sessions III (No. 16-73801, January 29, 2018) against the American Civil Liberties Union stating that immigrant children do not have the constitutional right to a free lawyer since the legal system already exists to give them a fair hearing. In addition, the Court stated that requiring the government to provide free legal assistance to immigrant children would be an expense that would “strain an already overextended immigration system.”
