DHS Intends to Remove H1-B Visa Holders Spouses’ Eligibility to Find Work

The Department of Homeland Security (DHS) on Thursday announced its intention to do away with the option of highly-skilled workers H1-B visa holders’ spouses on H-4 visas to find work. The Obama Administration in 2015 introduced the rule that H-4 visa holders are eligible to find work in the U.S. In addition, the DHS also intends to change the occupations eligible for the H1-B program that will be limited only to the best and brightest foreign nationals. There has been no report, however, of any formal or proper issuance by the DHS initiating the process for the revision or rescission of the rule. This announcement by the DHS is part of President Trump’s executive order to “buy American, hire American.”
