A person is eligible to apply for asylum if:

  1. She is unable or unwilling to return to her country of origin or residence because of persecution;
  2. She can prove actual persecution or a well-founded fear of persecution; and
  3. The persecution is because of that person’s:
    1. Race,
    2. Religion,
    3. Nationality,
    4. Membership in a particular social group, or
    5. Political opinion.

Not all persecution qualifies for the grant of asylum. Take note that it is only persecution because of the five (5) reasons of the applicant’s race, religion, nationality, membership in a particular social group, or political opinion. If the applicant has not actually suffered persecution, then she must prove that she has a well-founded fear of persecution.
