EB-3 Professional, Skilled and Other Workers

 

The employment-based, third preference visa is for skilled workers, professionals, or other workers.

How do I qualify for this visa?

  • Professionals with bachelor's or equivalent degrees
  • Skilled workers with at least two years of experience or training
  • Unskilled workers performing unskilled labor requiring less than two years training or experience, not of a temporary or seasonal nature.

Here, employers are required to have a successful application for labor certification before filing the immigrant petition on behalf of the foreign worker. Filing of the application for labor certification or the immigrant petition (in the case of those who are exempt from labor certification) sets the priority date which determines the order in which visas are issued. The priority date must be current before the EB-3 applicant can proceed to file the application for adjustment of status.
